Summary Judgment: Hillsborough County, Florida (Premises Liability)
Tampa Partner, Jason Hull and Associate, Robert White, secured summary judgment for a retail pharmacy chain in a premises liability case in Hillsborough County, Florida last week.
The case stemmed from an alleged incident in 2019. The plaintiff filed suit just before the statute of limitations expired. She claimed that a swinging half-door in the pharmacy area hit her in the back, causing disc herniation, disc disruption, and hip sprains.
Our summary judgment motion argued that the door was used in its normal course of operation and that its location was so open and obvious that it did not constitute a dangerous condition as a matter of law. The Court agreed and entered final summary judgment.
