Defense Verdict: Premises Liability (Broward County, Florida)
Fort Lauderdale Partners Jason Glusman and James Foster recently obtained a defense verdict on behalf of Publix Super Markets in a premises liability matter in Broward County, Florida.
This case involved a minor Plaintiff who claimed permanent injuries to her left ankle, right wrist, right ankle, left knee, and back, after a slip and fall in the store. While it was confirmed there was water on the floor, there was no evidence that Publix had actual or constructive notice of the water before the fall, and neither the child nor her mother could testify as to the possible origin. There was also inconsistent testimony about the details of the accident and the level of the minor child’s ongoing pain.
Throughout the course of discovery our team discovered a previous car accident in which Plaintiffs had sought similar damages on behalf of the minor child that Plaintiffs attempted to conceal throughout the course of this litigation.
Counsel for the Plaintiffs asked for over $500,000 in damages at trial. The jury found no negligence on the part of Publix, and returned a complete defense verdict.
