Defense Verdict: First Party Property Insurance (Miami-Dade County, Florida)

Miami partners Michael Holtmann and Elyse Malouf recently obtained a defense verdict in a first party property insurance claim in Miami-Dade County, Florida.

This case involved a property damage dispute against a homeowners insurance company where the company determined the damage was not covered under the insurance policy.  The Plaintiffs claimed that our client breached the insurance policy by denying their alleged windstorm claim.

The case was in litigation for four years and involved several nuanced issues, as the property was sold during the course of litigation and our testifying expert was unable to inspect the property because of the sale. The case ultimately proceeded to trial in April of 2026. After five days of testimony, the jury found there had been no breach of contract and returned a complete defense verdict.
