Order of Dismissal for Fraud on the Court: Pasco County, Florida (Premises Liability)

Tampa Partner Chris Cazin recently obtained an Order of Dismissal for Fraud on the Court on behalf of Publix Super Markets in a premises liability case in Pasco County, Florida.

The Plaintiff slipped and fell at a Publix store and claimed a right shoulder injury, requiring two surgeries, among other injuries. We successfully argued that the Plaintiff undertook efforts to conceal his extensive pre-incident history of significant right shoulder pain, diagnoses, and treatment, which went to the heart of his claim and warranted dismissal of the case. The Court agreed and dismissed the case with prejudice.
