Sean Farrell

Biography

Sean L. Farrell is a partner in the Naples office of Wicker Smith, where his work mostly focuses on premises liability, negligent security, and automobile negligence litigation, as well as some commercial real estate matters.

Since Sean joined the firm in 2023, he has represented some of the firm’s biggest clients in litigation all up and down the Gulf Coast of Florida. Whether he is interviewing witnesses on behalf of a major regional grocery chain or defending a deposition for one of the country’s major property and casualty insurers, Sean’s approach is the same: a relentless pursuit of the necessary facts and evidence to craft a defense for his client. His meticulous approach regularly results in favorable results, including dispositive motions in his clients’ favor or forcing reasonable settlements at mediation.

Prior to joining Wicker Smith, Sean spent eight years as the leader of the PIP department at his previous firm, representing doctors and clinics throughout the state of Florida.

Outside of the office, Sean is committed to giving back to his community. He is active in the Collier County Bar Association and is a former board member of the Lee County YMCA. Sean is also the founder of the Southwest Florida Bourbon Society, a social organization for bourbon aficionados that regularly holds fundraisers for various causes throughout Southwest Florida including Valerie’s House, Autism Services of Florida, and Community Cooperative.

In his free time, Sean’s priority is spending time with his wife and daughter. They enjoy traveling, attending Florida State football games, and spending time with their family and friends.

Representative Matters

Summary Judgment: Collier County, Florida (Premises Liability)

Naples Partner Drew Vogt and Associate Sean Farrell recently obtained summary judgment on behalf of Publix Super Markets in a premises liability case in Collier County, Florida. Plaintiff in this case alleged that he slipped and fell on a transitory substance in the meat department of a Publix store, sustaining injuries to his head, left shoulder, and left elbow. Plaintiff was not able to provide any credible testimony or evidence that there was any substance on the floor, and multiple Publix employees testified that the area was clean and dry, without any track marks, dirt, stickiness, water drops, or any other indication of any liquid having been on the ground. The department manager had performed a routine check of the area less than two minutes before the fall and found no dangerous condition, and the area required no cleanup when store associates arrived to assist the Plaintiff after his fall. We moved for summary judgment on the grounds that no existence of a potentially dangerous condition had been established, and additionally, that had such a condition existed at all, Publix had not been made aware of such a condition. The Court agreed, and entered summary judgment in Publix’s favor. Congratulations Drew and Sean on this great work.
