Jonathon S. Miller joined Wicker Smith in 2008 and is a shareholder in the Fort Lauderdale office. Jonathon earned his Bachelor of Arts degree from the University of California, Los Angeles (UCLA) in 2000, and went on to earn his Juris Doctor degree from Florida State University (FSU) in 2003, graduating with honors. He is licensed to practice law in both the State and Federal courts of Florida and New Jersey, and has received an “AV” Preeminent® rating by Martindale-Hubbell since 2014, the highest rating awarded by that organization. He has been recognized by Florida Trend’s Florida Legal Elite for the practice of Civil Trial in 2020 and as an “Up and Comer” in 2016. He was also listed as a “Rising Star” by Florida Super Lawyers in 2016 and 2017.

Upon graduating law school, Jonathon was privileged to complete a two-year appellate clerkship at the Fourth District Court of Appeal in West Palm Beach for the Honorable Mark E. Polen, who was Chief Judge at the time. There, he honed his finely polished legal research, writing and analytic skills and gained an inside view of the appellate process. He worked on over 100 appeals involving civil, criminal, probate and administrative matters.

Upon joining Wicker Smith, Jonathon has gained significant litigation and appellate experience. He practices in both the state and federal courts, focusing on premises and security liability, construction defects and liens laws, pharmacy negligence, discrimination claims, landlord-tenant law, condominium disputes and catastrophic personal injury lawsuits. Additionally, a thriving portion of his practice is devoted to commercial and real estate litigation on behalf of Fortune 500 companies, national real estate developers and closely-held REITs. Most recently, he has also started representing fixed-base operators in general aviation matters, commercial acquisition and financing transactions and aircraft liens, and he also is handling appeals in the First, Second, Third and Fourth Districts. Jonathon is adept at handling a gamut of discovery issues, and has taken hundreds of depositions and routinely drafts complex legal pleadings and memorandum of law. Additionally, he has also successfully argued countless dispositive and substantive legal issues at all stages of litigation, and has experience in arbitration and trial.

Prior to joining Wicker Smith, Jonathon represented over 600 different condominium (residential, commercial and mixed-use), homeowners and cooperative associations throughout the State of Florida. He has extensive experience in all aspects of condominium operation and governance, including drafting governing documents, covenant enforcement, commercial transactions, developer-turnover, fair-housing issues, liens and foreclosures, elections, recalls, and dispute resolution through arbitration and mediation. He has even testified as an expert witness in this arena.

Jonathon is a member of the Broward and Palm Beach County Bar Associations.

Representative Matters

Defense Verdict: Osceola County, Florida (General Liability)

Fort Lauderdale partners Jason Glusman, Jonathon Miller, and James Foster, and Miami partner Jaime Baca obtained a defense verdict in a catastrophic injury case on behalf of a large Florida-based grocery store in Osceola County, Florida, earlier this month. Plaintiff in this case was employed by an independent contractor that the grocery store used for maintenance jobs at their dairy processing plant. While performing his job duties under the instruction and supervision of his employer, Plaintiff was involved in a workplace accident that resulted in him incurring significant burns on his stomach and genitals. He was airlifted from the scene and spent several days in the hospital undergoing burn treatment protocols. In addition to the medical bills, the lawsuit included a claim for PTSD and a loss of consortium claim from Plaintiff’s wife, to whom he had been married just six months prior to the subject incident. At the end of a six-day trial, Plaintiff asked for $17 million in closing arguments. The jury found no liability on the part of our client, and returned a complete defense verdict. Due to the rejection of a Proposal for Settlement, our client will be entitled to seeks fees and costs; they also intend to pursue a separate action for indemnity from Plaintiff’s employer. Congratulations to everyone who worked on this difficult case.
