Summary Judgment: Orange County, Florida (Premises Liability)
Orlando Associate, Joshua M. Maus, recently obtained summary judgment in a premises liability case on behalf of an apartment complex in Orange County, Florida.
This 2021 case was original handled by another firm before being transferred to us at the client’s request. The Plaintiff alleged that she slipped and fell on the stairs of her apartment complex. She claimed injuries to her left knee, right wrist, right ankle, lower back, and neck, as well as swelling in her legs. Plaintiff could not provide any evidence as to what had actually caused her to fall – at times she alleged it was cracked concrete, at other times she alleged it was an unidentified transitory substance – nor was there any evidence that the apartment complex had any actual or constructive notice of any potentially dangerous condition. We moved for summary judgment on these grounds and the Court agreed, entering Final Summary Judgment in Favor of Defendants on January 29.
