Directed Verdict: Trucking Negligence (Miami-Dade County, Florida)

Fort Lauderdale Partner Robert Paradela and Associate Watsonie Denis, Esq. obtained a directed verdict in a trucking negligence case in Miami-Dade County, Florida last week.

This case arose from a trucking accident in which the Plaintiff pulled out directly in front of our client’s truck and was T-Boned at an intersection. Plaintiff claimed that he sustained multiple injuries to the entire left side of his body, as well as damage to his neck, back, and brain, as a result of the accident; he presented past medical bills in excess of $230,000. The defense maintained that our client had a green light, was traveling within the speed limit, and had the right of way, and that the Plaintiff caused the accident by entering the intersection without the right of way.

At the close of the Plaintiff’s case, Bob and Watsonie moved for a directed verdict based on the Plaintiff’s failure to present sufficient evidence of liability. The Court agreed and the Motion for Directed Verdict was granted. This result triggers a Proposal for Settlement, and our client will now be entitled to seek fees and costs dating from January 2024.
