William RoeBiographyWilliam J. Roe is an associate in Wicker Smith’s Jacksonville office where he focuses his practice primarily on automobile negligence, wrongful death, products liability, premises liability, transportation and trucking and general civil litigation. Upon graduating law school, William predominately focused his career on property insurance litigation where he represented homeowners and mitigation companies throughout the State of Florida. William briefly went back to Indiana to practice before deciding to return to Florida. After returning to Florida, William owned and operated his own law firm for over seven years, representing homeowners and mitigation companies with insurance claims. William attended Indiana University, where he earned a Bachelor of Arts degree in East Asian Studies and a minor in Criminal Justice. He went on to receive his Juris Doctor degree from St. Thomas University School of Law in 2010. While attending law school, he served as an active member of the Intercultural Human Rights Law Review and St. Thomas University Mock Trial Team. He also earned a Book Award in Professional Responsibility. William is admitted to practice law in the states of Florida and Indiana. Outside of practicing law, he enjoys hiking, playing drums, learning jiu jitsu and spending time with his wife, Jessica and their dog, Lola, and two cats, Buzz and Buttons. Upon graduating law school, William predominately focused his career on property insurance litigation where he represented homeowners and mitigation companies throughout the State of Florida. William briefly went back to Indiana to practice before deciding to return to Florida. Dismissal Upheld: Duval County, Florida (Auto Negligence)
Jacksonville Associate William Roe and Partner Chris Brown recently handled a case that was dismissed by the lower court and upheld by the Florida Fifth District Court of Appeal.
The underlying cause of action involved a multiple car rear-end accident on the expressway where our insured was cited for improper speed and not paying attention. As a result of the subject accident, Plaintiff complained of neck pain, back pain, headaches, and right shoulder pain where he later underwent a right shoulder arthroscopy with rotator cuff repair. The lower court dismissed the action due to Plaintiff’s failure to attend the case management conference. Plaintiff moved for reconsideration citing excusable neglect, which the lower court denied.
Plaintiff then appealed to the Fifth DCA. In the Answer Brief, William Roe argued that there had been no error on the part of the lower court, and that Plaintiff’s argument of excusable neglect did not meet the standard of review. The appellate court agreed, and upheld the lower court’s dismissal of the case. The statute of limitations has now passed and Plaintiff is barred from bringing another lawsuit.
