Andrew H. Bate is a 20+ year Florida attorney who has earned an AV Preeminent rating from Martindale Hubbell. Andy is a resident of the Naples, Florida office and has been involved with the defense of claims and lawsuits in Florida and many other States in the areas of healthcare, marine, products and professional and general liability matters.
After practicing in the courtroom for fifteen (15) years and becoming a partner in a major Miami, Florida defense firm in the 1990’s, Andy was recruited by Health Management Associates, Inc. (“HMA”) in 2002 to create a corporate risk management department including the formation and management of two (2) captive insurance subsidiaries. This process included feasibility studies and governmental/administrative compliance efforts (Cayman and USA) as well as recruitment of all related Third Party Administrator, Panel Counsel, Actuary, and management resources.
As Vice President of Risk Management & Insurance for HMA, Andy managed a department of more than 100 hospital risk managers and a panel of counsel comprised of more than 30 law firms in 17 States. During this time, Wicker Smith was selected as HMA’s primary defense counsel and assisted HMA with all of the legal aspects of corporate and healthcare risk management from coverage questions to the defense of catastrophic claims. Wicker, Smith was designated primary Florida trial counsel and assisted HMA in the strategic management of catastrophic claims nationwide. The firm also assisted HMA with the development of the first corporate program designed to manage effectively the disclosures warranted by newly passed Florida Amendment 7.
Andy also brings a unique perspective to marine issues and maritime claims. Having personally worked in many positions throughout the yachting industry, he is familiar with all aspects of vessel acquisition, ownership, operation, and maintenance. Andy has crewed on large motor yachts in the Mediterranean Sea, sailed extensively throughout the East Coast U.S.A. and Bahamas, and fished the offshore waters of Florida including both the Atlantic and Gulf of Mexico.
This experience provides real benefit in the handling of all types of marine matters, including catastrophic personal injury and death cases involving yachts, claims arising from shipyard fires and other maintenance related events, and other general maritime events. With qualified contacts throughout the yachting industry, claims can be evaluated and managed with increased efficiency.
Andy has also defended many physicians and lawyers in professional liability matters. Medical malpractice experience includes all aspects of the provision of healthcare, including physicians and staff as well as entities ranging from hospitals and clinics to mental health and psychiatric facilities. Andy’s experience in the defense of legal malpractice claims ranges from probate and estate disputes to commercial and contract matters.
Andy attended Washington College and the University of Baltimore Law School in Maryland and was recruited by Miami law firm Kimbrell & Hamann, P.A. upon graduation in 1987. He is a married father of three adult children. He and his family moved to Naples from Miami in 2002 and enjoy boating, fishing and sailing whenever possible.
